A trademark is a word, phrase, symbol or design that identifies and distinguishes the source of the goods of one party from those of another.

A service mark is similar to a trademark, except that it identifies and distinguishes the source of a service rather than a product.

Trademark rights arise out of use of the mark as a source identifier. If continually used and not abandoned, a trademark has an unlimited lifespan.
